Drunk driving is a serious issue that shouldn't be taken lightly. If you've been charged with a DUI in San Diego, it can seem like an overwhelming situation especially if this is your first offense. Follow the tips listed here and it will release some of the headache and stress:
1. One of the first things you want to do is request a DMV hearing. In California you only have 10 calendar days to schedule a hearing. You can do this yourself, but it's probably best that you have your DUI lawyer do it for you so that the date of your hearing coordinates with your lawyer's calendar.
2. As you get ready for your hearing, try to remember and write down the events leading up to and during the DUI stop. Your lawyer will be able to better assist you if you can remember the conversation between you and the convicting officer. It’s also good to know which field sobriety tests were used. Did you say anything that could be used against you during your trial? Did the officer read you your rights?
3. Just because you were registered at having a blood alcohol level (BAC) over .08% doesn’t mean your case is lost. Your lawyer can determine whether or not the machine or method used to measure your BAC was accurate or not. There are many factors involved that can affect your BAC that you may not even know about. I know of a case in which a painter was arrested for drunk driving because some of the chemicals in the paint caused the breathalyzer machine to register a high BAC.
4. Find a San Diego DUI attorney that specializes in DUI defense. There are many DUI lawyers in San Diego, but you want to hire one who specifically with drunk driving cases. You wouldn't hire a plumber to fix your car problem, right? Same concept applies to lawyers. You definitely don't want to hire a lawyer who doesn't know anything about DUI laws and procedures.
5. Whatever you do, always try to remain positive through the whole process! You can do it by yourself, but it's always nice to have a San Diego DUI lawyer to represent you who is experienced and knows what he/she is doing. This will give you the confidence you need when it's time to face the court!
