Every once in awhile we need a reminder about the dangers and consequences of drunk driving...

DUIAttorney.com reports of a San Diego DUI related accident involving an alleged drunk driver by the name of Nico Faulk. The victim of the accident, Patrick Michael Elerding, was pronounced dead at the scene. Faulk is now facing felony drunk driving and vehicular manslaughter charges.

The DUI Crackdown On Labor Day Weekend

Drunk driving is an issue that continues to pervade our society. During this time of year with summer outings and bbq gatherings, drinking is common activity. With the Labor Day holiday just around the corner, people still continue to party and wind down the summer festivities. According to the Insurance Institute for Highway Safety, August and September are among the most deadly periods on the roadways.

The Governors Highway Safety Association(R) (GHSA), a nonprofit association representing the highway safety offices of states, is joining forces with law enforcement officers across the country to take part in the national "Drunk Driving. Over the Limit. Under Arrest." crackdown on impaired driving during the Labor Day holiday period. The crackdown, which runs from August 21 through September 7, includes sobriety checkpoints and saturation patrols, as well as a $13 million national media campaign supplemented by state-funded advertising.

San Diego DUI Checkpoint Reminders

The horse racing season is in full swing at the Del Mar racetracks which means that there could be more incidences of drunk driving in the area. For the past few years law enforcement in the Del Mar area has had to contribute extra resources toward the problem of DUI during this season because there are too many people who fail to drive responsibly or arrange for a ride home after a day at the track. In San Diego County there are usually plenty of resources available for DUI checkpoints. Incentives and grants are provided at the federal, state, and regional level.

Keep these things in mind if you do come across a DUI checkpoint in San Diego:
  • You do have the right to turn around to avoid going through a checkpoint.
  • Field sobriety tests are optional.
  • You have the right to request a blood test instead of breathing into a breathalyzer machine.
  • You do not have to answer any of the officer's questions except for confirming your address, license, and providing car insurance. Politely decline to answer questions and let the officer know that you don't want to answer questions unless your San Diego DUI lawyer is present.
